Service update - preparation of complex documents
From Monday 30 August 2021, NSW Trustee & Guardian will temporarily suspend preparation services for complex Wills (and/or Powers of Attorney appointments, if applicable) for customers who have certain asset structures or require certain complex provisions in Wills as follows:
• self-managed superannuation funds (SMSF)
• inter vivos trusts
• Control or ownership (as director and/or shareholder) of a private company
• Ownership of a business (apart from sole trader businesses)
• rights of residence
• life interests
• options to purchase
• other complex instructions.
These complex matters require specialist solicitors to review and ensure each customer is offered the best advice when making their documents with us. As such, our waitlist requiring specialised succession advice is at capacity.
Exceptions may apply if you:
- have been placed on a previous waitlist
- need to appoint us as the executor of the Will or attorney under the Power of Attorney.

Definitions
- rights of residence
Gives a beneficiary the right to live in a property for a period of time. At the end of the right of residence the property passes to other beneficiaries.
- options to purchase
Gives a person nominated in a Will the first right to purchase property from the estate. The Will usually sets out how the purchase price and any other conditions of the purchase will be determined.
- life interests
A person’s right to use and benefit from an asset for the duration of their life. If the asset is real estate, this person is called a ‘life tenant’.
- inter vivos trusts
A trust established by someone in their life time governed by a trust deed. Common types include family discretionary and unit trusts.
